WHEREAS, Title 7, Chapter 58, of the Delaware Code provides assistance grants in an amount not to exceed seventy-five percent of the purchase price of land to be acquired by incorporated municipalities for park, recreation, and conservation purposes and

BE IT RESOLVED to authorize William C. Henry, County Engineer of Sussex County, to execute a Contract on behalf of Sussex County Council with L. H. Doane and Associates, Inc. for the preparation of a Comprehensive Area Wide Water Plan and Program subject to the approval of the Contract by the County Attorney.

BE IT RESOLVED that Herman S. Muir, Jr., former County Administrator, be removed as applicant's agent for the project known as Sussex County Industrial Airpark and that William C. Henry be appointed as applicant's agent to apply for and receive Government Grants for additional improvements to Sussex County Industrial Airpark EPA Project No. 01-01-00927.

BE IT RESOLVED that the Sussex County Council go on record as having made a commitment that they will construct a rail spur into the Industrial Air Park, contingent on some assurance that rail service will be maintained for some agreed period of time.

WHEREAS, Sussex County Council has accepted the bid of Kuhn Construction Company of Hockessin, Delaware for additional improvements to Sussex County Industrial Airpark, EDA Project No. 01-01-00927 in accordance with the plans and specifications incorporating alternates 1, 2 and 3B and Kuhn Construction Company letter dated March 7th, 1973 which decreases the unit prices for items 13a, 13c, 13d, 16a, 17a, 18a and 35a in the amount of $676,506.00;

BE IT RESOLVED that the Sussex County Council go on record to make recommendation that the Nanticoke River Bridges be built at the height that will take care of the necessary traffic.

WHEREAS, Title 7, Chapter 58, of the Delaware Code provides assistance grants in an amount not to exceed seventy-five percent of the purchase price of land to be acquired by incorporated municipalities for park, recreation, and conservation purposes, and

Sussex County Council desires the Department of Highways and transportation of the State of Delaware to install permanent paving on State Road 373 between State Roads 365 and 369 to improve the vehicular access to Sussex County Landfill Site No. 6;

BE IT HEREBY RESOLVED that Saturday, June 2, 1973 be known as Sussex's "Operation Sam" Day.

WHEREAS, the Sussex Central High School Band recently participated in a band competition in Canada;

TO ACCEPT A PETITION FROM THE PROPERTY OWNERS OF OAK DRIVE SUBDIVISION REQUESTING THE PAVING AND MAINTENANCE OF THE STREETS WITHIN THEIR SUBDIVISION

AUTHORIZING A CONTRACT TO BE EXECUTED BETWEEN SUSSEX COUNTY COUNCIL AND THE UNIVERSITY OF DELAWARE FOR BASELINE STUDIES FOR THE ENVIRONMENTAL ASSESSMENT OF SUSSEX COUNTY OCEAN OUTFALLS

TO DESIGNATE THE MONTH OF SEPTEMBER, 1973 AS "SAMUEL SUSSEX'S PITCH-IN MONTH".

BE IT HEREBY RESOLVED that the Sussex County Council send the Proposed Amendment to the Comprehensive Zoning Ordinance, as proposed by William E. Moore and Gary A. Myers of the Community Legal Aid Society, Inc. to the Sussex County Planning and Zoning Commission under the direction that they follow the procedures as set forth in Article 15 of the Sussex County Zoning Ordinance as pertains to Amendments.

WHEREAS, it has come to the attention of the Sussex County Council that dwelling structures which are essentially mobile and of the mobile home type of structure are presently being constructed in such a manner as to circumvent the prohibition against the placement of mobile home structures in zoning districts in which mobile homes are not normally allowed to be placed;

BE IT HEREBY RESOLVED that Mr. Sidwell be authorized to borrow a total of $85,528.48 for the John T. Reager property from the Wilmington Trust Company at four percent interest for the Dewey Beach Sewer District Water Tower and Pumping Station.

APPOINTING WILLIAM C. HENRY AS APPLICANT'S AGENT TO APPLY FOR AND RECEIVE GOVERNMENT GRANTS FOR IMPROVEMENTS TO SUSSEX COUNTY INDUSTRIAL AIRPARK EDA PROJECT NO. 01-11-00590

WHEREAS, Sussex County Council herein called the "Applicant", after thorough consideration of the various aspects of the problem and study of available data, has hereby determined that the construction of certain works, required for the collection and treatment of sewage, generally described as Wastewater Collection System, Dewey Beach Water and Sanitary District, herein called the "Project", is desirable and in the public interest, and to that end it is necessary that action preliminary to the construction of said Project be taken immediately;

BE IT RESOLVED that the application of Mispillion Associates for a Conditional Use of land in AR1 Agricultural Residential District for an established Cultural Center and related commercial activities including boating facilities to be located on the north side of road 36 west of road 14 on the south side of Mispillion River near the Milford bypass and containing 14.996 acres, a public hearing for which was held July 26, 1973, be and the same is hereby granted:

WHEREAS, Sussex County Council herein called the "Applicant", after thorough consideration of the various aspects of the problem and study of available data, has hereby determined that the construction of certain works, required for the collection and treatment of sewage, generally described as Wastewater Collection System, Fenwick Island Water and Sanitary District, herein called the "Project", is desirable and in the public interest, and to that end, it is necessary that action preliminary to the construction of said Project be taken immediately;

WHEREAS, Sussex County Council herein called the "Applicant", after thorough consideration of the various aspects of the problem and study of available data, has hereby determined that the construction of certain works, required for the collection and treatment of sewage, generally described as Wastewater Collection System, South Bethany Water and Sanitary District, herein called the "Project", is desirable and in the public interest, and to that end it is necessary that action preliminary to the construction of said Project be taken immediately;

AUTHORIZING THE PLANNING AND ZONING COMMISSION OF SUSSEX COUNTY TO REMOVE THE TOWN OF SOUTH BETHANY FROM THE COMPREHENSIVE ZONING ORDINANCE OF SUSSEX COUNTY AS OF OCTOBER 14, 1973

AUTHORIZING FILING OF APPLICATION WITH THE ECONOMIC DEVELOPMENT ADMINISTRATION, U. S. DEPARTMENT OF COMMERCE, UNITED STATES OF AMERICA, FOR A GRANT UNDER THE TERMS OF PUBLIC LAW 89-136 AS AMENDED

BE IT RESOLVED to authorize Ralph F. Sidwell, Director of Finance, to borrow for the County of Sussex, Georgetown, Delaware, $125,000.00 at the lowest possible interest rate from a bank in the State of Delaware. This amount represents the interim financing for Rail Spurs at the Industrial Airpark, Sussex County Airport, Georgetown, Delaware.

BE IT RESOLVED that the County Council of Sussex County does hereby appropriate an amount not to exceed $150,000.00 for the purpose of Industrial Airpark Rail Spurs contingent upon the award of a grant by the Economic Development Administration in the amount of $100,000.00 and the Chief Financial Officer is hereby authorized to expend funds for the purpose of the aforementioned project, from deposit on hand or certificate of deposit.

BE IT HEREBY RESOLVED that the Sussex County Council does approve the purchase of land to be used for a pumping station in the Bethany Beach Sanitary Sewer District at a price of $14,000.00 for Lot 29 and part of 28 at the corner of Tingle Avenue and Route 26 in Bethany Beach and a sales commission of $1,400.00 to be paid the Real Estate Agent and an additional $3,820.00 to be paid for the 38 ft. building restriction for a total purchase price of $19,220.00;
