WHEREAS, the County Council of Sussex County, Delaware is authorized to design, construct, maintain and operate sewage collection and treatment facilities to serve the sewage districts designated as the Bethany Sanitary Sewage District and the South Bethany Sanitary Sewage District;

WHEREAS, Sussex County Council is vitally concerned with the preservation and restoration of the dunes in that they are vital to the protection of coastal properties;

WHEREAS, Sussex County Council has requested and received an eighty percent Grant from the U. S. Department of Commerce, Economic Development Administration, for construction of Phase I of the Sussex County Industrial Air Park;

WHEREAS, Sussex County Council has requested and received an eighty percent Grant from the U. S. Department of Commerce, Economic Development Administration, for construction of Phase I of the Sussex County Industrial Air Park;

BE IT RESOLVED to authorize Ralph F. Sidwell, Director of Finance, to borrow for the County of Sussex, Georgetown, Delaware, $337,500.00 from the Farmers Bank of the State of Delaware, for a period of one year, which represents the interim financing for Phase II of the Industrial Air Park, Sussex County Air Port, Georgetown, Delaware.

BE IT RESOLVED to appropriate $300,000.00 for Sussex County's forty percent portion of Phase II project of the Industrial Air Park, Georgetown, Delaware.

BE IT RESOLVED that the Sussex County Council and the government of Sussex do hereby ordain that Mr. John B. Moore, Jr., residing in Cambridge, Maryland with headquarters in Annapolis, Maryland, an employee of the U. S. Economic Development Administration, being a traveler of the Delmarva peninsula, is an Honorary Citizen of Sussex County, Delaware. Mr. Moore is to receive all kindness of a respected citizen of this county for all time forward.

BE IT RESOLVED that the County Council of Sussex County appropriate $6,250.00 as its share of the 1972 annual work program as contained in the Sussex County H. U. D. application for certification.

BE IT RESOLVED to authorize Mr. Muir, County Administrator, to make application for a Grant to the Farmers Home Administration for a water study of Sussex County, whereby the County will participate $3,000.00.

PROCLAMATION OF CONSUMER INFORMATION WEEK, MAY 1-6, 1972.

WHEREAS, Title 7, Chapter 58, of the Delaware Code provides assistance grants in an amount not to exceed seventy-five percent of the purchase price of land to be acquired by incorporated municipalities for park, recreation, and conservation purposes;

WHEREAS, SUSSEX COUNTY COUNCIL herein called the "Applicant", after thorough consideration of the various aspects of the problem and study of available data, has hereby determined that the construction of certain works, required for the distribution of water and the collection of sanitary sewage, generally described as WATER DISTRIBUTION AND SANITARY SEWAGE COLLECTION SYSTEMS for the Dewey Beach Water and Sewer District herein called the "Project" as desirable and in the public interest, and to that end it is necessary that action preliminary to the construction of said Project taken immediately;

BE IT RESOLVED to authorize Mr. Muir, County Administrator, to sign the contract between the County and State Planning Office for Urban Planning Assistance.

WHEREAS, the eligible voters of the proposed South Bethany Water District approved the creation of the water district by a vote of 369 to 81 in an election held July 22, 1972;

WHEREAS, County Council of Sussex County has received and reviewed the survey and plot of Quaker Heights, near Lewes, from the Division of Highways as required by Section 504, Title 9, Delaware Code;

BE IT RESOLVED that Richard L. Timmons be authorized to accept an agreement of Public Works for planning preparation in regards to the Bethany Sewer District, substituting the figure $22,597.80 where figure $51,400.00 appears, and by deleting preliminary and final planning in the first paragraph and in lieu of insert the word preliminary planning.

The County Council of Sussex County, Delaware, hereby resolves to borrow the sum of $225,000.00 from the Farmers Bank of the State of Delaware, with interest at the rate of 3% per annum, for a period of six months from this date, the said fund represents funds expended in the Public Works Impact Program and to be paid upon receipt of funds from the Federal Government under the Industrial Park Grant.

BE IT RESOLVED that the President and Vice President of the Sussex County Council execute a contract with the City of Rehoboth Beach for provisions of a sanitary waste water disposal service through the John M. LeCato Regional Waste Water Disposal District, subject to approval of the County Attorney, William Swain Lee.

BE IT RESOLVED to authorize the President and Vice President of the County Council of Sussex County, Delaware to execute a contract with the City of Lewes, Delaware, for the provision of sanitary wastewater disposal service through the John M. LeCato Regional Wastewater Disposal District, subject to the approval of the Assistant County Attorney, Jackson R. Dunlap.

BE IT RESOLVED to authorize Richard L. Timmons, President of the County Council of Sussex County to apply, execute application for and accept grants from the Department of Housing and Urban Development for the Dewey Beach Water and Sewer System.

BE IT RESOLVED to authorize the Comptroller to increase the salary of Mary Hill, Chief Deputy, Register in Chancery, seven per cent, retroactive to July 1, 1972, as approved by the Internal Revenue Service and ordered by Vice Chancellor Duffy.

WHEREAS, the eligible voters of the proposed Fenwick Island Water and Sanitary Sewer District approved the creation of the water district by a vote of 583 to 94 and the water district by a vote of 566 to 82;

BE IT RESOLVED that the County Council of Sussex County hereby requests the Division of Highways to survey and make a plot of the suburban community known as "Sandy Brae", near Rehoboth Beach, Sussex County, Delaware, a plan of revision of which is recorded in the office of the Recorder of Deeds, Georgetown, Delaware in P. B. Vol. 8, page 51, in accordance with the provision of Title 9 Del. C., Section 405.

WHEREAS, the present regulation of the Division of Highways requires streets within new and existing residential developments to be built to standards which are far greater than necessary, which often exceed the standards of the state roads they join, and which are prohibitive to builders of low and moderate income developments;

BE IT RESOLVED that the County Council of Sussex County hereby requests that the Division of Highways reduce the paving requirements for secondary highways to the previous standard permitting the use of "tar and chip" to surface such roads to be improved with the allotted funds.

WHEREAS, the State Board of Health has determined that the Northeasterly portion of Rehoboth Bay, all of Indian River West of Oak Orchard, all of Pepper's Creek leading from Indian River Bay in a Southwesterly direction, and all of White's Creek leading in a Southerly direction from Indian River Bay have been determined to be polluted and closed for the taking of shellfish;

BE IT RESOLVED to authorize William C. Henry, Sussex County Engineer, to apply for and accept federal grants for South Bethany, Bethany, and Fenwick Island Sanitary Districts.

BE IT RESOLVED that each employee of the Sussex County government be given one Christmas shopping day, providing it does not interfere with the operation of the office.

BE IT RESOLVED to authorize William C. Henry, Sussex County Engineer, to apply for and accept federal grants for Dewey Beach Water and Sewer District.

BE IT RESOLVED that Mr. Sidwell, Finance Director, be authorized to countersign checks as of January 1, 1973.

BE IT RESOLVED to authorize Mr. Henry, County Engineer, to sign applications for federal grants for the South Bethany Sanitary District.

BE IT RESOLVED to authorize Mr. Timmons, President of the Sussex County Council to sign the Sussex County Equal Employment Opportunity Statement for transmittal to HUD through the Delaware State Planning Office.

BE IT RESOLVED to authorize Mr. Henry, County Engineer, to proceed with the necessary documents to secure a County loan for the town of Frankford in order to extend the water and filter system to Honolulu Road.
