BE IT RESOLVED that the County Council of Sussex County does approve and support the position of State Representative, The Honorable Harry Derrickson, in his position and work which would propose a limitation on the dumping of garbage and refuse by any governmental agency or subdivision thereof, which would include the geographical areas of Pennsylvania, New Jersey, Delaware and Maryland, within 100 miles of the Sussex County Shoreline.

BE IT RESOLVED that the County Council of Sussex County supports the position of our State Legislators and Administration in their respective efforts to obtain Revenue Sharing between the Federal Government, the cities, communities and states, as the same might be administered to the sharing plans established by and between the Federal Government and the respective States of the Union.

WHEREAS, Sussex County Council herein call the "Applicant", after thorough consideration of the various aspects of the problem and study of available data, has hereby determined that the construction of certain works, required for the treatment of sewage, generally described as Dewey Beach Water and Sanitary District Intercepting Sewers, Pumping Stations and Force Mains, herein called the "Project", is desirable and in the public interest, and to that end it is necessary that action preliminary to the construction of said Project be taken immediately;

WHEREAS, pursuant to the provisions of Chapter 65, Title 9 of the Delaware Code, the County of Sussex by its authorized government, the Levy Court of Sussex County, did establish by Resolution of said Levy Court passed at its regular session on August 25th, 1970 a Sanitary Sewerage District known as the Bethany Beach Sanitary Sewerage District;

WHEREAS, pursuant to the filing of a petition by the freeholders of Hudson Development, a suburban community, the Division of Highways submitted a survey and a plot of said community in accordance with Title 9, Delaware Code, Section 504;

WHEREAS, the retirement of Harvey H. Lawson an employee of Sussex County, State of Delaware, from his duties as assessor in the Board of Assessment presents a suitable opportunity for expressing the esteem in which we hold him as a faithful and satisfactory public servant,

ACCEPTING THE RIGHTS AND OBLIGATIONS OF THE TOWN OF BETHANY BEACH IN THE U. S. DEPARTMENT OF HOUSING AND URBAN RENEWAL AGREEMENT FOR PUBLIC WORKS PLAN PREPARATION FOR PROJECT NUMBER P-DEL-3006

WHEREAS, certain areas of the County are subject to periodic flooding from the Atlantic Ocean causing serious damage to residential properties within these areas;

BE IT RESOLVED that the County Council of Sussex County be and it is hereby authorized to execute and issue an anticipatory note dated March 15, 1971 in the sum of One Million Eight Hundred Fifty Thousand Dollars ($1,850,000.00), said note not to bear interest at a rate greater than two and five-eights percent (2-5/8%) per annum, said note to be issued for the "Courthouse Building Fund", such fund being used solely for the payment of costs of the construction of a new Courthouse, including parking areas and landscaped areas or improvements to the existing Courthouse, including additions or repairs or both, pursuant to contracts for such new constructions or additions or repairs to the existing Courthouse which have been executed. Such note by its terms shall be redeemable at par plus accrued interest on three (3) days notice and shall be signed by the President and one additional member.

WHEREAS, subsequent to a Public Hearing to be held at Dover, Delaware on Wednesday, March 24, 1971 by the Department of Health and Social Services, it is possible that the said Department may adopt certain regulations governing drinking water standards for the State of Delaware;

WHEREAS, Sussex County Council accepted an offer from the United States Government for an advance for preparation of planning documents pertaining to a public work described as sewers and sewage treatment system for the Town of Bethany Beach;

WHEREAS, upon the recommendation of the Planning and Zoning Commission it has been suggested that the Comprehensive Zoning Ordinance be amended regarding the location and placement of commercial chicken houses;

WHEREAS, by virtue of the terms, conditions and purposes of Senate Bill No. 125 of the Senate of the State of Delaware, passed at its 1968 session, the County Council of Sussex County, successor by law to the Levy Court of Sussex County, was authorized, among other things, to borrow money for the construction and enlargement of the Courthouse and additions thereto at Georgetown, Sussex County, Delaware;

WHEREAS, Sussex County Council herein called the "Applicant", after thorough consideration of the various aspects of the problem and study of available data, has hereby determined that the construction of certain works, required for the treatment of sewage, generally described as Sanitary Sewers, Pumping Station, Force Mains, and Sewage Treatment Plant herein called the "Project" is desirable and in the public interest, and to that end it is necessary that action preliminary to the construction of said Project be taken immediately;

BE IT RESOLVED that the application of Soil and Water Conservation District of Sussex County, to the General Assembly of the State of Delaware, be and it hereby is approved, and recommended to the General Assembly for passage into law:

RESOLUTION PROVIDING FOR THE SALE OF THE $2,000,000 COURT HOUSE BONDS OF SUSSEX COUNTY DATED July 1, 1971

RESOLUTION PRESCRIBING DETAILS OF $2,000,000 COURT HOUSE BONDS OF SUSSEX COUNTY DATED JULY 1, 1971

BE IT RESOLVED that the County Council of Sussex County authorize Richard L. Timmons, President, to execute an Agreement on behalf of the County Council of Sussex County and the Division of Economic Development, Department of Community Affairs and Economic Development, whereby the Division of Economic Development will pay to the Sussex County Council the pro-rata share of the cost of renovating the Sussex County Airport according to the terms and conditions set forth in House Bill 702

WHEREAS, by virtue of the provisions of Senate Bill 702 adopted June 25, 1971, granting homerule to Sussex County, the authority for the adoption of pay plans and procedures was vested exclusively with and in the County Council of Sussex County;

WHEREAS, pursuant to a Resolution adopted on the 25th day of May, A. D. 1971, Notice of Sale of the Courthouse Bonds was to be published in the Daily Bond Buyer at least ten (10) days before the sale;

WHEREAS, Sussex County has undertaken a comprehensive zoning of Sussex County which provides for the regulation and development of the entire County, which plan provides for the proper and orderly development of all areas of this County;

BE IT RESOLVED that the County Council of Sussex County authorize the transfer of $50,000.00 from the Tax Sale Account to be deposited in a Certificate of Deposit in the Farmers Bank, State of Delawrae at 5 1/2%.

BE IT RESOLVED that the Budget be and it hereby is amended to include an appropriation in the amount of forty thousand dollars ($40,000.00) for the Sussex County S.P.C.A. payable at ten thousand dollars ($10,000.00) per year for a term of four years.

BE IT RESOLVED that the salary of Walter Sherwin, Civil Defense Director, be altered and revised under pay grade 20, column 3, to eight thousand, nine hundred eighty-eight dollars, ($8,988.00) to conform with the State pay scale.

BE IT RESOLVED that all excess revenue over expenditures be included in the Contingency Fund.

BE IT RESOLVED that the Proposed Operating Budget for Sussex County for the year ended June 30, 1972, be adopted as heretofore amended.

BE IT RESOLVED that the tax rate for the fiscal year ended June 30, 1972, be and the same hereby is set at the rate of forty-five cents (.45) per one hundred dollars ($100.00) of assessed value, and that ten cents (.10) per one hundred dollars ($100.00) assessed value levied as the assessment for the Courthouse Building Fund, and that there shall be and there hereby is levied a capitation tax in the sum of three dollars ($3.00) upon each citizen of Sussex County of the age of twenty-one (21) years and upward.

WHEREAS, the County Council has received the following sealed proposals for the purchase of the $2,000,000 Courthouse Bonds of Sussex County, dated July 1, 1971, as provided in the Notice of Sale of said bonds heretofore published:

BE IT RESOLVED that the County Council of Sussex County, be and it is hereby authorized to execute and issue an anticipatory note dated June 30, 1971, in the sum of One Million Nine Hundred Fifty Thousand Dollars ($1,950,000.00) said note not to bear interest at a rate greater than three percent (3%) per annum, said note to be issued for the "Courthouse Building Fund", such fund being used solely for the payment of costs of the construction of a new Courthouse, including parking areas and landscaped areas or improvements to the existing Courthouse, including additions or repairs or both, pursuant to contracts for such new constructions or additions or repairs to the existing Courthouse which have been executed. Such note by its terms shall be redeemable at par plus accrued interest on three (3) days notice and shall be signed by the President and one additional member.

BE IT RESOLVED that the County Council of Sussex County approve the Zoning Map as presented by the Planning and Zoning Commission.

BE IT RESOLVED that Richard L. Timmons, President of the Sussex County Council, is hereby authorized to apply for, sign the application and accept such grant funds as are available from the Environmental Protection Agency for the use of the Badger system in the installation of a portion of the sewer collection system in the Bethany Beach Sewer District.

BE IT RESOLVED that the Sussex County Council adopt the following boundary lines for the Fenwick Island Water and Sewer District:

BE IT RESOLVED to establish an account in the Wilmington Trust Company for the purpose of deposits from the U. S. Government and withdraws for total expenses for the entire Emergency Employment Act program. The signature account verification will be by the hand of Ralph Sidwell, Director of Finance and Herman S. Muir, County Administrator.

WHEREAS, it is the responsibility of the County Council and the County Planning and Zoning Commission to insure the orderly development of land used in accordance with the present and future needs, the health, safety, convenience, and general welfare of the inhabitants of Sussex County;

BE IT HEREBY RESOLVED that the Sussex County Council be committed to secure a 34-1 approach slope for runway 22, NE end, and maintain the existing 20-1 approach slope for runway 4, at the Sussex County Airport.

BE IT RESOLVED to remove the moratorium that was imposed on September 14, 1971 on the Conditional Use of Mobile Home Parks and Campgrounds for campers and to extend for a period of sixty (60) days the moratorium on new GR Districts and on GR Subdivisions.

BE IT RESOLVED to express our pride to Laurel High School Football Team and coach, William Pugh, in their selection as the State Championship tournament and our best wishes for their continued success and are proud to have them represent Sussex County.

WHEREAS, under the terms of Public Law 89-136 as amended, the United States of America has authorized the making of grants to public bodies and private or public nonprofit organizations or associations to aid in financing the construction of specific projects,

BE IT RESOLVED that the County Council of Sussex County hereby authorizes Ralph Sidwell, Director of Finance, to open and maintain a bond and coupon account in the Farmers Bank of the State of Delaware; and he is further authorized and enpowered to endorse and sign checks, drafts and orders for the payment of funds from the said account, with a deposit of $52,500.00 from the Building Fund Tax Account and transfer from the Building Fund Tax Account to the Building Fund Account $20,000.00.

BE IT RESOLVED that the County Council of Sussex County does hereby appropriate an amount not to exceed $100,000.00 for the purpose of EDA project No. 01-11-00590 contingent upon the award of an 80% grant by EDA and Chief Financial Officer is hereby authorized to expend funds for the purpose of the aforementioned project, from deposit on hand or certificates of deposit.

WHEREAS, the United States Coast Guard has proposed new regulations governing the Penn Central Railroad bridge across the Nanticoke River at Seaford providing that such bridge be closed to river traffic from 8:00 P. M. to 8:00 A. M. each day from October 1 to April 30;
