Quitclaim deeds are used to transfer ownership interest in a property, without guaranteeing that the property is free of debt. The grantor is signing over whatever interest he or she may have in the property. Quitclaim deeds are often used when purported heirs or adjoining property owners wish to convey and release any rights that they may have in property, the title to which is disputed.

Our office accepts Quitclaim Deeds for recording, as long as they meet our recording and margin requirements. While these deeds do not currently need to be prepared by an attorney under Delaware law, we strongly urge the retention of private counsel to advise you.

The duties of the Office of the Recorder of Deeds are prescribed by State law (9 Del. C. Ch. 96) and do not include the provision of legal advice; therefore, members of our staff may not help or consult you in the preparation of these deeds.
